Iola man found not guilty in mother’s killing

Iolan Brandon W. Callahan, accused of the first-degree murder of his mother, Lucretia, in January 2017, has been found not guilty because of his mental state at the time the crime was committed.

Allen County District Judge Daniel Creitz subsequently ordered Callahan, 36, be kept at a state mental hospital in Larned for ongoing treatment and safekeeping.

The ruling was handed down during a bench trial Dec. 3.

As part of the stipulated facts prior the trial, prosecutors and defense attorneys agreed Callahan “suffered from a mental disease or defect such that it would preclude (Callahan) from being found guilty.”

The attorneys cited police reports and a competency evaluation submitted by Larned State Hospital.

Callahan has been in custody since turning himself into authorities on Jan. 17, 2017.

Iola police officers discovered Lucretia Callahan’s body in her home in the 10 block of West Edwards Street.

With the ruling, the chief medical officer at Larned has 30 days to submit a written evaluation of Callahan’s condition. Creitz then has 60 days to schedule a competency hearing to determine if Callahan should remain at Larned or another state hospital, or be released.
