EPA fines Whitaker $7,500 for failure to report info

HUMBOLDT — Whitaker Aggregates, Humboldt, has agreed to pay a $7,500 civil penalty to the Environmental Protection Agency for “failing to respond to an information request” through EPA’s Clean Water Act.

The agreement was announced by the EPA in a Monday press release.

The fine against Whitaker, doing business as Centerville Quarry, came after the company failed to provide the EPA several reports and other documents demonstrating the company’s compliance with the Clean Water Act.

“EPA relies on information requests to successfully ensure regulated facilities are in compliance with applicable regulations,” EPA Region 7 Administrator Jim Gulliford said in the press release. “Failing to respond to information requests reduces EPA’s ability to protect human health and the environment, while potentially increasing risk to the communities surrounding these facilities.”

There was no indication, aside from the missing report, that the company was out of compliance.

The company has until late September to pay the penalty.

The settlement is subject to a 30-day public comment period before finalization. Individuals may submit written comments to the EPA Regional Hearing Clerk at 11201 Renner Blvd., Lenexa, KS 66219. Please reference Docket No. CWA-07-2019-0187 when submitting written comments.
